Terms and Conditions for Skyline Internet Access

Please read the following information carefully before signing CAF and using this service. You may not use the service without accepting these Terms and Conditions.
The terms "We"/"Us"/"Our"/”Company”/”Skyline” individually and collectively refer to Skyline Infonet Pvt. Ltd. and the terms "Visitor”/”User”/”You” refer to the users.
Welcome to the Skyline high-speed Internet access system. These "Terms and Conditions of Use", govern User rights and responsibilities and Company rights and responsibilities relating to the use of the Internet Connection System.
Acceptance of Terms and Conditions of Use. BY Signing CAF and CLICKING ON "Log in” ON THE MY ACCOUNT SYSTEM SIGN-UP PAGE, YOU REPRESENT that:
1. YOU HAVE READ, UNDERSTAND AND AGREE TO THE TERMS OF THIS AGREEMENT.
2. YOU ARE AT LEAST 18 YEARS OF AGE.
If you do not agree to the terms of this Agreement, you may not use the Skyline Internet Connection and don’t Signing on CAF. Your acceptance of the Agreement by Signing CAF and electronic acceptance of the Agreement by clicking on "Log in” on the sign-up page has the same effect as if you had actually signed the Agreement. The effective date of this Agreement is the date that you Signing CAF and click on "Log in”. Description of Skyline Internet Policies /Service Availability/ Access to Internet.GENRAL INSTRUCTION
- Skyline will generate Username/Login ID and inform the same to customer.
- Payments will be collected as per plans in advance.
- The tariffs are exclusive of Goods and Service Tax (GST), unless mentioned otherwise. One month denotes 28 days unless specified otherwise.
- Minimum 90 Day’s contract in urban area and 180 Day`s contract in rural area (Remote Location) from the date of installation if customer discontinues services on or before contract expiry Skyline will have the legal right to charge payment of remaining period.
- The prepaid / PayAsYouGo Billing once processed, can neither be refunded for cash nor be transferred to any other account.
- Unutilized free benefits will be forfeited at the end of validity.
- Availability and Feasibility of Service.
- Availability of services subject to subscriber location and technical feasibility.
- Customer Premises Equipment (CPE) Requirements:
- CPE (Router) recommended for a single PC, which requires a Ethernet port in your PC and separate power supply socket.
- CPE (Router) recommended for multiple user on LAN setup, which requires a Ethernet port (RJ 45) on your LAN Hub/Switch/PC.
- Operating System:- Windows 7 & above and Operating System drivers, Internet browsers :- Internet Explorer 6.0, etc.
- In case the PC does not have requisite Software and Hardware, the same is to be got installed by customer at his own cost from PC vendor/ supplier.
- If Customer wishes to use his own CPE (Router) must be compatible as per Department of Telecom norms Skyline shall not be responsible for any complications arising from non-compatibility of CPE / Router Software & Hardware procured from market.
- LAN infrastructure (Cabling & Ports) up-gradation, reconfiguration would be the customers responsibility.
- The Password given by Skyline would be used for the first time login and thereafter Customer shall change & customize his Password.

- Power over Ethernet (POE) Adapter is not a part of warranty / grantee along with CPE(Customer Premises Equipment). Replacement of faulty POE will be charged Rs. 750 /-.
- Security Deposit:
- An interest-free refundable security deposit (“Security Deposit”) shall be deposited by the User in the manner stipulated by the Company.
- The Refundable Deposit is being obtained purely to secure the Company for the purposes of proper handling and Continuous Use of the Service Equipment and its safe return by the User to the Company, as per Terms.
- The User acknowledges and agrees that the Company has the right to transfer the Refundable Deposit to Company/Partner, at any point of time and without prior notice to the User, for the purposes of and in accordance with terms of the Facility.
- The Company shall, without prejudice to its rights and remedies under any law or in equity, have a right of lien over the Refundable Deposit for satisfaction of all the obligations under the Terms by the User.
- Installation, Commissioning and Maintenance:
- User hereby permits and undertakes to procure all necessary permissions to permit the Company, access to the Premises on need-basis, at reasonable hours and after prior notice (except in cases of emergency), for the purposes of: installing, commissioning, repairing and maintaining the FTTH/CPE Assets and/or the Service Equipment; and
- commence and carry out installation, cabling, ducting, flooring activities, and any other activities required, including laying out cables and all works incidental and/or ancillary thereto, as may be deemed necessary by the Company to install, commission, repair and maintain the FTTH/CPE Assets and/or the Service Equipment.
- The Company shall have the right to share FTTH/CPE Assets with its affiliates, third parties and other customers in any manner whatsoever, for which no separate consent shall be required.
- The installation and commissioning of FTTH/CPE Assets and/or the Service Equipment shall be in accordance with the installation and commissioning process as stipulated by the Company from time to time. Without prejudice to the generality of the foregoing, the Company shall be entitled to stipulate, in terms of such process, the procedure for booking appointments for installation and commissioning, the feasibility inspections that the Company may perform as a pre-requisite for installation and commissioning, the approvals from Building Authorities that the Recipient should furnish before commencement of installation and commissioning, the actual process of installation and commissioning, including timelines, materials provided free-of-cost and/or on chargeable basis during such installation and commissioning, the policy for works at the Premises, etc.
- Force Majeure:
- If at any time, during the continuance of Services, the Services are interrupted, discontinued either whole or in part, by reason of war, war-like situation, civil commotion, theft, wilful destruction, terrorist attack, sabotage, fire, flood, earthquake, riots, explosion, epidemic, quarantine, strikes, lock out, compliance with any acts or directions of any judicial, statutory or regulatory authority or any others Acts of God, the Recipient shall not make any claim against the Company.
- Definition: Broadband Internet Service - An ‘always-on’ data connection that is able to support interactive services including Internet access and has the capability of the minimum download speed of 256 kilobits per second (kbps) to an individual subscriber from the Point Of Presence (POP) of the service provider int\nding to provide Broadband Internet service where multiple such individual Broadband connections are aggregated and the subscriber is able to access these interactive services including the Internet through this POP. The interactive services will exclude any services for which a separate licence is specifically required, for example, real-time voice transmission, except to the extent that it is presently permitted under ISP licence with Internet Telephony.”
- IP addresses allocated to customer by Skyline are non-portable & shall continue to remain the exclusive property of Skyline Infonet Private Limited.
- Skyline shall be free to update Internet access progressively to bring in new features. Skyline may not be in a position to intimate Customer immediately; however it will endeavour to make it known to subscribers through phone or email.
- The customer of Skyline Broadband Internet services is not allowed to resale the Internet Services.
- The customer is required to fully comply with the provisions of the Indian Telegraph Act, 1885 and Information Technology (IT) Act, 2000 & the Indian Telegraph Rules made there under and any amendments or replacements made there to from time to time.
- The customer is required to ensure that objectionable or obscene messages or communications, which are inconsistent with the established laws of the country, are not made by him or any other person using his password.
- Skyline revise the tariff for Skyline Broadband Internet Services from time to time at its discretion.
- Broadband connection is location specific & customer shall not remove or, shift any equipment installed by Skyline at the customer’s premises (the said location).
- Customer assumes total responsibility and risk for use of the Skyline Broadband Internet services. Neither Skyline nor its affiliates make any express or implied warranties, representations or endorsements whatsoever (including without limitation warranties of title or non-infringement, or the implied warranties of merchantability or fitness for a particular purpose) with regard to any merchandise information or service provided through the internet, any they shall not be liable for any cost or damage arising either directly or indirectly from any such transaction. It is solely customer’s responsibility to evaluate the accuracy, completeness and usefulness of all opinions, advice, services and other information, and the quality and merchantability of all merchandise, provided through the services or in the Internet generally.
- Notwithstanding anything contained herein, Skyline reserves the right to access information over the network established by the customer, if required in pursuance of the laws of the land, and as specifically provided for under the Information Technology Act, 2000.
- The customer shall not indulge in any direct or indirect acts of reverse engineering in this connection.
- Customer understands further that the Internet contains unedited materials some of which are sexually explicit or may be offensive to some people. Customers access such materials at their own risk. Skyline has no control over and accepts no responsibility whatsoever for such materials.
- The customer is required to desist from putting unsolicited messaging on server hosted at Skyline premises. The customer is required to ensure that objectionable or obscene messages or communications, which are inconsistent with the established laws of the country, are not made by him or any other person on the Web Server or web space of the customer.
- The service is provided on an ‘AS IS and AVAILABLE’ basis without warranties of any kind, either express or implied, including but not limited to warranties of title, non-infringement or implied warranties of merchantability of fitness for particular purpose. No advice or information given by Skyline, its affiliates or their respective employees shall create a warranty. Neither Skyline nor its affiliates warrants that the service will be uninterrupted or error free or that any information, software or other material accessible on the service is free of viruses, worms, Trojan horses or other harmful components.
- Under no circumstances shall Skyline, its affiliates or its contractors be liable for any direct, indirect, incidental, special, punitive, or consequential damages that result in any way from customers use of or inability to use the service or to access the Internet or any part thereof, or customers reliance on or use of information, services or merchandise provided on or through the service, or that result from mistakes, omissions, interruptions, deletion of files, errors, defects, delays in operation, or transmission, or any failure of performance.
- Payment of bills – it would be the responsibility of customer to make payment to Skyline Broadband Internet service. Skyline would disconnect the service in case of non-receipt of payment without giving any notice to the customer. All the charges payments related to Broadband Internet services shall be paid on or before DUE date to avoid late payment charges.
- TRAI has d\fin\d Broadband as an always-on data connection with minimum speed of 256 Kbps.This speed includes TCPIP headers etc.
- Skyline Infonet Private Limited Services has the right to update its services without prior intimation to the Customer.
- Skyline would try to maintain its network as reliable as possible. However, it would own no responsibility in case of interruptions in the network beyond its reasonable control.
- Skyline Infonet Pvt. Ltd. will make its best endeavors to upgrade network capacity so as to provide desired speed of the connection to the customer. However the customer understand and actknowledges that it be able to connect and operate at such speed as determined by network resources available at that time.
- Customer of Skyline Services shall not interconnect the services with any Public Network.
- Customer of Skyline Services shall not use this service for voice over Internet / voice over Internet protocol services.
- Customer of Skyline Services shall not use this service for any other purpose other than IP protocol data services.
- The Customer is required to desist from sending unsolicited messaging via Skyline's Services.
- The Customer shall ensure that objectionable or obscene messages or communications, which are inconsistent with the established laws of the country, are not created, accessed, transmitted or retransmitted by him or any other person using this password.
- Skyline may revise the tariff for its Services from time to time at its discretion. Customer agrees to pay the monthly subscription charges in advance for the particular month failing which the service will be disconnected.
- Under no circumstances shall Skyline, its affiliates or its contractors be liable for any direct, access the internet or any part thereof, or customers reliance on or use of information, services or merchandise provided on or through the service, or that result from mistakes, omissions, interruptions, deletion of files, errors, defects, delays in operation, or transmission or any failure of performance.
- Disclaimer:- While every effort is made by Skyline to provide highest quality services to the Customer of the Skyline services. Skyline shall in no event be responsible to the customer in any manner whatsoever for any failure, detect, delay in connectivity or accidental loss of connectivity of the Customer with Skyline Infonet Private Limited network computer or the deficiency in data.
- Transmission between the Customer and Skyline network computers, or for any inconvenience, damage or loss that may be caused to any one or of any kind arising there from.
- In case of the Skyline providing and enabling the use of value added services like video on Demand, Pay per View, Voice over IP, Interactive gaming, Video Phone the Customer shall ensure that nothing in terms of software and content is used without appropriate rights and licenses. Skyline remains totally indemnified for any legal implications either physical or commercial in regard.
- The Customer carries all responsibility for the Public IP / Private IP provided by Company time to time. Skyline is not responsible for any illegal activity made on such IP.
- If customer using the Skyline Infonet Private Limited Services for commercial purpose like cyber café the custome should follow cyber café law and all the rules and regulations provided by TRAI and Indian Telegraph Act 1855.The customer required to fully comply with the provision Indian Telegraph Act 1855, and the Indian Telegraph Rules made there under and any amendments or replacements made there to from time to time.
- Private Limited's Services, the jurisdiction to adjudicate the same shall exclusively lie in the courts within the territorial jurisdiction of
- The Customer indemnifies Skyline Infonet Private Limited shall keep Skyline Infonet Private Limited indemnified against any action from regulatory authorities. In case Skyline Infonet Private Limited detect any violation of service conditions by the Customer as described above, Skyline at its sole discretion could stop the service without any notice to the Customer.
- Connection will be disconnected without any prior notice after due date.
- Late Payment Charges Rs 200/- will be charged after due date mentioned in the Invoice.
- Reconnection Charged Rs. 500/- will charged after disconnection due to non-payment.
- Payment of this bill by cheque / cash / online means you accept and declare that you have read above terms and conditions and unconditionally agree to abide by these terms and conditions.
- If customer using wi-fi connectivity in their premises that should be informed to Skyline. Customer solely responsible to use wi-fi connection and its security.
- If any business need registration with State or Central Government that should be registered and informed to Skyline Infonet Pvt. Ltd
- “Company” have right, whether acting for itself and/or on behalf of any of its affiliates and/or its third-party suppliers and/or its licensors and/or service providers. Wherever the context so permits, “Company” shall mean and include its authorised agents, service providers, sub-contractors and representatives.
- Arbitration of Disputes -
- That in case of any dispute or differences, breach & violation relating to the terms and conditions the said matter or dispute, difference shall be referred to the sole arbitration of CEO or any other person appointed by him. That the award of arbitrator shall be final and binding on both the parties. In the event of such Arbitrator to whom the matter is originally referred to is being transferred or vacates his office on resignation or other wise or refuses to do work or neglecting his work or being unable to act as Arbitrator for any reasons whatsoever, the CEO SKYLINE shall appoint another person to act as Arbitrator in place of outgoing Arbitrator and the person so appointed shall be entitled to proceed further with the reference from the stage at which it was left by the predecessor. Subscriber will have No objection in any such appointment that arbitrator so appointed is an employee of the SKYLINE, same as above, the said Arbitrator shall act as under the Provision of the Arbitration and conciliation Act, 1996 or any statutory modification or re-enactment thereof or any rules made thereof.
- Dispute Resolution:
- All disputes shall be governed under the laws of India and are subject to the jurisdiction of the Courts of Jaipur only.

How to Deactivate or Cancel Skyline Broadband Connection
- To deactivate Skyline broadband connection visit your nearest Branch.
- Surrender your FTTH Box and modem splitter. Don’t forget to get a receipt.
- Get the outstanding bill amount and Pay your bill , don’t forget to get a receipt.
- Ask the executive to create a disconnection request.
- Also send an email to support@skylineworld.net
- The process will be completed in maximum five working days.
- Skyline retention cell will try your Mobile number to contact you about your disconnection request has been processed or not.
- If you haven’t provided your Mobile number with your broadband connection, Please call 9828069327 and confirm it.
- Or you can call 9772094777 . Ask them you want to disconnect your broadband connection.
